Investments undertaken thanks to the growth of tourism have contributed to a planned and organised urban infrastructure. There are two main means of transport to reach the area: by plane or coach. In Natal there is a port, but only for cargo ships. There is a small urban train network, but the long distance lines are not working. By coach you can reach the “Cidade do sol” Station where you can take a coach to the most important cities in Brazil. There is also a bus and minibus service that works generally well. Due to the continuous tourist development of the area, a bridge of large dimensions is being built, which will reduce the distance between Natal and Lagoa do Coelho from 60 to 30 minutes. If you want to rent a car in Natal, you can either do so from the agencies located in the airport or you can make your reservation in advance. 17- What is Brazil’s Government system? Brazil is a Federative Republic. Natal is the capital of the State of Río Grande do Norte, whose Governor is Mrs Wilma María de Faria, member of the PSB: Brazilian Socialist Party. The mayor of Natal is Mr Carlos Eduardo Alves (PSB). 18- Is there political and/or social instability in Lagoa? Even though there are still differences among the neighbourhoods, they are not as noticeable as in other areas of the country. The surroundings of Lagoa and the nearest important city, Natal, are much safer than the majority of cities in the rest of the country. The security forces are always present and the Government, as part of its commitment to develop tourism, gives instructions as to how to act in order to efficiently overcome any conflict. 20- What are Lagoa’s national festivities? 7th of September- Independence Day 5th of October – Constitution Day. Natal is famous for NOT celebrating the Carnival in February. Their characteristic festivity is the “Carnatal” which is celebrated each year in November or December. It is a carnival-like event, where people dance and sing, with different musical styles and costumes. 21- What kind of medical assistance is there in Lagoa? In the Lagoa do Coelho residential resort there will be a Medical Centre where immediate assistance will be provided. The Centre will be in charge of transferring patients to the closest hospital, if necessary. These are some of the nearest hospitals with an emergency service, in Natal: -“Hospital Monseñor Walfredo Gurgel”: the biggest public hospital in Natal. -“ Natal Hospital Centre” and “ PAPI”, two private hospitals dealing with almost all medical specialities. - “Instituto do Coração de Natal”, another private hospital with assistance 24 hours a day. 22- Being a non-resident, are there any restrictions to own a property in Lagoa? The following, among others, are considered as non-residents in Brazil: - those not residing in Brazil permanently - those who entered Brazil with a temporary visa and remained in the country up to 183 days, whether consecutive or not, throughout a period of twelve months. Any natural or legal person who owns goods or rights in Brazil subject to registration at public bodies, such as immovable property, current accounts, shareholding stakes or investments in financial and capital markets, is forced to register at the Land Register for either Natural or Legal Persons (CPF or CNPJ), accordingly. Registration can be carried out by anyone who fills in a specific form and submits it at any Brazilian diplomatic representative office. 23- What procedure is there to follow in order to receive the foreigners’ Title Deed and how much does it cost? The purchasing of property takes place when two persons (natural or legal) execute a transaction where one of them transfers to the other a specific immovable asset, whether it is by purchase or sale, donation, exchange or any other transaction foreseen under Brazilian law. In order for an immovable asset to be purchased, it is necessary that the transfer certificate (purchase and sale, exchange, donation...) be registered at the relevant Immovable Property Register. Urban immovable assets are annually subject to the Land Property Urban Territory (IPTU), local tax on the value of the immovable asset, according to tax rates that vary significantly from one municipality to another. In the case of Natal, the applicable rate is 0.6% for urban immovable assets under 1,000m2. 24- In the case of shared properties, who is awarded the Title Deed? In the case that the property is purchased by two or more persons, both will have to meet the conditions established when the purchaser is only one person, since the property will be registered in the name of each of the parts executing the purchase. 25- Do I need to write my will in Lagoa? You only need to present a Dead Certificate. 26- Can I buy more than one property? Yes. 27- What construction style will be used? To create the infrastructure, we will invest in the highest technology and in top quality materials. The first architectural feature is the harmonic integration of buildings within the landscape, respecting the environment and adapting the structures to the land’s topography. 28- What are the general features of the buildings? The buildings will have 4, 6 and 8 levels, this way you will be able to enjoy a panoramic view from all the apartments. The dwellings are inspired by the area’s native style and they fully respect the natural environment. Horizontal and simple shapes made of rustic materials prevail. The paving material will be easily maintained and its texture and colour will be adapted to the activity carried out in the area. A way to finance the purchase of an immovable asset in Brazil is by contracting a loan with a commercial bank. A loan contract for the purchase of an immovable asset is generally associated to the award of a mortgage on the property in favour of the bank. Attention should be drawn to the fact that the interest rate can be very high due to the fact that it is a long-term loan. 38- Are there any taxes included in the purchasing price? No. 39- What taxes do we have to pay and how much are they? Brazilian taxes relating to immovable property are divided into four categories: -Income Tax: when the owner obtains a surplus value derived from the property. The Brazilian Central Bank does not allow funds to be transferred abroad unless the payer proves that all accrued taxes have been paid. In particular in property related transactions, the Income Tax shall be paid to enable the transfer of income abroad. The Income Tax is only charged in two situations: in the cases when, for income obtained as a result of the rental of the property or, for the surplus value obtained from the sale of the property, the rate of tax is 15%, regardless of whether the transferor is a natural or legal person who is non-resident in Brazil, as far as taxation is concerned. Furthermore, there are certain tax incentives in the event that the sum obtained form the property sale is used to purchase another property. Nevertheless, only natural persons who are residents in Brazil can enjoy such tax benefits. It should be highlighted that, in conformance with the 10.833/03 Act currently in force, the Income Tax would be also applied with regard to surplus value derived from purchase and sale transactions between two persons who are non-resident in Brazil, as far as taxation is concerned. In brief, the location of the immovable property in a certain place is what determines the taxation on the income obtained by the transferor. Attention should also be drawn to the fact that if the transferor resides in a tax haven, the rate of tax will be 25% and not 15%. Lastly, the person responsible for paying this Tax shall be the same proxy designated in Brazil for the signature of the Public Deed and for its submission at the Property Register for registration. -Property transfer tax: there are three ways of transferring an immovable asset: - inheritance (mortis causa) - donation - business transaction The tax on the transfer of goods and rights by inheritance mortis causa or by donation (ITCMD) is 4% in Natal. The inter vivos transfer tax is 3%. These taxes are calculated according to the value of the property. An aspect to be taken into account regarding these Taxes is that the Property Register will not accept any document for registration unless these taxes have been previously paid; it is worth reminding that the Title Deed of an immovable asset in Brazil is only valid once it has been registered at the Property Register. - Property Tax: to be paid by owners. It is paid every year; the rate of tax varies according to the location and use of the property. - Taxes on exchange contracts: IOF is a federal tax charged on credit transactions, insurance, foreign exchange and stock market operations. Thus, it is charged on all exchange contracts for the transfer of funds abroad. In some cases there are IOF exemptions, for instance in the case of the transfer of rental income and in that of the price paid in a property sale. Nevertheless, this tax can be subject to amendments any time by means of a new unexpected decree. CPMF is a federal contribution due when funds are withdrawn from a bank account, when funds are transferred from a savings account into a bank account, or when funds are withdrawn from bank accounts to be invested in financial funds. The Brazilian Taxation Administration uses this tax to inspect the financial transactions of taxpayers, therefore it is a powerful tool for the Taxation Administration to check on any attempt of having non-declared incomes.
